UK: Confused about British nationality law / access to a passport ... am I able to access a British passport?
Find answers to your legal question.

UK: Confused about British nationality law / access to a passport ... am I able to access a British passport?

- Both of my parents are British citizens, born in the United Kingdom (Merseyside)

- Parents moved to the US, and I was born in the US and am a US citizen

- Parents possess British and US dual-citizenship

- I'm 19 years old

I've heard that because my parents are British citizens, I may be able to have access to a British passport, but I did some research and it's quite confusing. Something about only being born after 1983 and then something else about being born after 2006.

Just wondering if I am able to access a British passport or not, due to both parents being citizens of the UK, with UK passports.

Because your parents are British citizens 'otherwise than by descent', you are already a British citizen 'by descent' and are eligible to apply for a British passport.

Your parents were born in the UK before 1983 which guarantees that they are citizens 'otherwise than by descent' and you are their child who was born overseas and that's all that is necessary.

Here's how you apply for a British passport. If you have the required documents, you don't need to do anything else (such as proving your citizenship) before you apply:

Yes, you are a British citizen by descent, you can apply for a passport by contact the British Embassy and asking them to send you an application form

The law changed in so that after January 1983 no one born in the UK could automatically lay claim to British citzienship unless their parents were British citizens or considered to be permanently settled. The changes in 2006 related to citizens of other EU member states & changes in how they lay claim to permanent residence which in turn affects whether or not their children can claim British citizenship
