My husband and I are currently working in US on H1-B visa. Although he has started this green card process its in the very first stage on processing and based on the current situation it probably will take a long time before anything happens. I think we are expecting at least 6-7 years for green card, assuming everything goes smoothly. I don't see my company filing for my greencard.
Since the wait for greencard is too long, we were thinking to apply for Canadian citizenship next year to buy some time for our US green card. In case if we don,t get it..we will migrate to Canada.
I believe that we need to wait an year to get the permanent resident card for Canada, after which we have 3 years to complete certain number of days to stay there? correct me if I am wrong.
So my questions are,
1) Can we apply for both American greencard and Canada permanent resident card at the same time?
2) We are applying for Canada permnant card as a safety measure as we don't want to go back to home country (India)...and if our US green card processing gets stopped or something (as it is job based) So if in 3 years we still don't go back to Canada, can we re-apply for it?

YES but it is not advisable. If USCIS find out that you are also applying elsewhere, they will close your application to USA immiediately.

As long as you are both legally living in USA you can apply to Canada
You must use the skilled worker or the provincial nominee program (PNP) to apply for Canada. The skilled worker from USA to Canada is currently taking 2 years. PNP in Canada from USA is 5 to 9 months - BUT if you do choose a province, you CANNOT leave the province (to live elsewhere) for 3 years. |

You are probably looking towards the Alberta H1B program. If you are, it will take about a year to process. You will lose your PR again unless you stay in Canada at least 2 out of every 5 years. You are not eligible to apply for Canadian citizenship unless you live in Canada as a PR for 3 years.
If you lose your PR because you didn't go and live in Canada, you can apply for it again, yes, if you still qualify for some immigration program. They are always changing. The H1B program in Alberta might not be there anymore but you might qualify for something else.
Alberta PNP has no problem with you applying for Green Card at the same time, it even says so in their FAQ at http://www.albertacanada.com/immigration/media/h1b_FAQ.pdf question 8.
However, I would ask you to reconsider and think about what you are doing. The time that you are wasting in the Alberta PNP system could go to process somebody who actually wants a Canadian PR. |

"Buying some time to get our green card" isn't a reason that will make you a more attractive candidate for Canada.
You can apply to migrate to Canada see below but you may find it a long and expensive process, even if you are accepted. |
