Visa waver overstay. Can this be waved... Please HELP?

if you come here on a visa waver and overstay, and immigration catches you, with an attorney by your side, can your overstay be wavered and you be allowed to stay in the US? It is to my knowledge that with a visa waiver you sign papers saying that you will return to your place of citizenship within the stated time. If you do not you are booted out of the US and cannot return without permission, which is hard to get. And that by signing these papers you forfeit your righst to have relief or be seen by a judge and if caught overstaying will be automatically processed, detained, and sent back to your place of citizenship. So again, is it possible with an attorney to have your the papers you signed and the overstay be waived.....or will you just hands down no chance be deported?

was in the process of obtaining a residency status already too.... does that make any difference or do you still receive the boot?

No. Part of the Visa Waiver Program is that you have no chance to make an appeal. Further, you are not allowed to use the Visa Waiver Program for the rest of your life. All further trips to the USA will require a visa.
Over stay of more than 6 months results in a 3 year bar, over 1 year is a 10 year bar. |

No ... there is no appeal your are out and banned for an overstay if its over 6 months ...
nor can you ever use the visa waiver again ..you have to apply for a B-2 ...

Technically, no. However, there are exceptions for humanitarian reasons. Contact the port of entry where you obtained your I-94W and explain your reasons. They may direct you to provide documented proof of your emergency to the officer that would have authority to extend your I-94W. Since you have dragged your attorney into this, you've already given away your intent to immigrate and live in the U.S. |
