Hello! Perhaps you can help:
I filed the I-130 petition for my husband (immigration visa) to the California Service Center, which was received September 4, 2008. According to the "Normal" processing time of 6 months, they are over a month and a half late in responding (either approval notice or request for more evidence). Nothing yet, but one month ago we did submit a service request to investigate why they are so late in processing our case. They have 45 days to respond to this service request, so a little more than two weeks to go. But is there anything else that can be done in the meantime? If your suggestion is "get a lawyer", how does that help, exactly? We are really eager to hear any suggestions or pieces of advice. My husband is from the Middle East, which *might* explain some delays in the process...but who knows.
Usually, we would just sit back and wait, but once he gets the approval notice he will be eligible for a tourist visa from the U.S. embassy in Kuwait, where he works, and there is a special event we were planning for him to attend here with me (when we were planning according to the timeframe USCIS offered us). So any advice that can keep us busy and proactive is much, much appreciated!

Call the congressman of your state. Let them know the urgency of this application, and perhaps they can get the ball rolling for you. My husband and I waited forever for the removal of conditions, and they were dragging their feet. I could not get an answer anywhere until I contacted my congressman.
Low and behold, after they got ahold of INS, I was issued an interview within 2 weeks, and the card was granted about 2 months after that. |

They had announced on their website that they had a surge of application/petitions from 2007 to process. It is very frustrating to deal with. I am waiting for my I-29F to be processed, but it hasn't been 6 months as yet. I think you should have filed the I-29F for a K-3 visa and he could wait in the US until his I-130 is processed. I'm using the same form but different visa type. I'm trying to get my fiance' to the US. He will come up on a K-1 visa. Hope it works out soon for you. You may also want to call and bug them. |
