We filed my husbands immigration papers 02/28/09 and we are wondering what the next steps are?

We sent in all the papers for the I-130, I-765 & I-485, Received NOA's for all have been received and we even already received our biometrics appointment letter! Just curious how this process works from here, ANY information would be most helpful!

After he completes his fingerprinting and name check, he will receive his EAD first. In a couple months he will be scheduled for his first interview to establish residency based on marriage. Once approved in another few months he will get his Conditional residency for 2 yrs. at the completion of the 2 yrs. you will need to file another form to remove conditional residency, you may be scheduled for another interview and then granted the 10 yr. permanent residency.
When I applied, I didn't have to go through the conditional residency because we were already married for 2 yrs. when I applied for adjustment of status. So we filed all the above forms in MArch or April 2005 and I had my 10 yr. greencard in January 2006. It took less than a year.... |
