To Jay S: lots of things were legal before that are now illegal and vice versa. Slavery was legal--now it is illegal. Abortion used to be illegal it is now legal. Racial discrimination used to be legal, now it is illegal. etc. We have to deal with what is the law NOW, not 200 years ago or even 20 years ago. What happened back then is done.
