What are the U.S rules about flying over from scotland and staying there on a green card working visa ?ANSWER?

Okay, so im going over to florida to live. But obviously i know it aint that simple, i want to move over there and stay there full time and work over there. I need a green card but what about a visa ? What kind of visa do i need ? How much will it cost ? Where can i apply for it ? How long will it take before i get it, if i get it ? I dont want to go over there for 12 months i want to go over there full time, straight away, and be a US citizen, so please help me. And i dont want any answers "like you sound like you cant walk to tesco" because this is very important and serious, and im getting so stressed out about it. Big thanks in advance (: x

Depend a great deal on what you PhD or Master is in ...
But its interesting orlando airport denies entry to about 6 people
a day who say the same as you ... ..you must have the employment visa first


There are basically NINE ways that you can get a visa to live and work in the US:

(1) Marriage (or engagement in anticipation of marriage) to a US citizen.

(2) You have skills that are in short supply in the US e.g. scientific or medical training. A degree is normally a must. Or you have superior specialist skills with at least 12 years experience. (H visas)

(3) You have an Employer who is willing to transfer you - but even the employer has to make a good case for you - so you have to be a manager unless you fall under category (2) above.(L visas)

(4) You may get a Green card in the diversity lottery (UK citizens, except N.Ireland, are not generally eligible unless you, your spouse or parents were born abroad or held a different citizenship.

(5)You own or buy business (does not get you permanent resident status i.e. no green card)You must be a national of a qualifying Treaty countries. The business must have a minimum value of around $150k (more the better) bearing in mind you will need somewhere to live and with any startup business you will need at least 2 years living money as back up. So a figure of $350k would be a nearer minimum (E-2 visas)

(6)You are an "investor" i.e. you have at least US $1m in assets to bring with you. half of that in a few areas. And your background will be investigated to the hilt. (EB-5 visas)

(7)You have a close relative (mother, father, brother, sister and no further) who is an US citizen who would sponsor you, approx time this take 2-12 years?

(8.The R1 visa is available to foreign members of religious denominations, having bona fide non-profit religious organizations in the U.S., for entering the U.S. to carry on the activities of a minister or religious worker as a profession, occupation or vocation

(9)THE UNUSUAL You are in a position to claim refugee status/political asylum. or You get a member of Congress to sponsor a private bill with legislation that applies just to you.
The S visa issued to persons who assist US law enforcement to investigate and prosecute crimes and terrorist activities such as money laundering and organized crime


Recruitment agent will not take you seriously if you are not already in the US. Writing for jobs is really a waste of time; likewise US employers have no idea what foreign qualification are or mean (except Degrees) it may pay you to get your qualification translated into a US equivalent, there are Companies that do this (www.wes.org) ..
But if you are getting a visa under (2) above then you need a job offer before you can get the visa. Your Employer will be your sponsor this will cost them upward of $5k. So you can see you have to be offering something really special to get considered They may also have to prove to the Dept of labor that there is no American who can do the job if the position is to be permanent ©

You need an immigrant visa to get a Green Card. It's also possible to come over on a non-immigrant visa and eventually adjust it to immigrant status and get a Green Card.

An immigrant visa is best obtained via members of your immediate family already living in the USA, preferably as US citizens..... spouse, parent(s), sibling(s).

Non-immigrant visas that have potential for conversion are things like H1B work visa, fiance visa, student visa (very long process and you must get your degree first), etc...

If you come over on the Visa Waiver Program there is absolutely NO POSSIBILITY of adjusting your status.

It is a quite difficult process, it can take up to many years.

Here is a suitable way for you, but it is hard.

So you may apply to a University here in the US, after you finished school in Scotland. If you do get accepted, You may apply for an F1 student Visa, which expires after you graduate. You may not work on this Visa outside of campus, and you're not considered a resident, because you cannot change your status from a student Visa to a lawful resident in the US.

After you graduate, you are asked to go back to Scotland. You're NOT allowed to continue, and change your status in order to live and work here. Sorry, just doesn't work that way.

Once you're in the Scotland , you may look for a Job in the U.S. the same time, but you must have a skill in order to get a Job in the US. What I mean by skill is in the fields of Engineering, Medicine, Business and Law. You also must earn an Advanced degree, minimum would be a bachelor, but most employers are looking for masters. But the Employer has to proof that no other US citizen has that skill for a job position, and that you as a foreigner do. If this is the case, he may file you for an H1B working Visa.

Now once you were approved, and receive your working Visa (which can take up to few years), You may start your Job there, and extend your Visa form 3 years, to 10 years, in the meantime your Employer may as well sponsor you for a Green Card (Permanent Residency), and he/she will have to invest thousands just for that.

Another way would be to marry a US citizen.

You're not flying to Florida without the requisite visa to "live" and approved by the US embassy.You're going to have to say more about yourself concerning your education and work skills in order for a more successful answer.It is faaaaar from easy to come here.
