What can I do for my Boyfriend to stay in America?

My Boyfriend is from Brazil and Iam from Germany but Iam an American Citizen.My Boyfriend entered the United States thru Mexico 4 Years ago therefore he didn't enter the United States with a Visa.I want to live with him here in America and I need to know what I can do for him not being send back to Brazil. He is afraid of being deported and not be able to come back does anybody have an Advise on what I can do to help him I really don't wanna loose him. Please I need an Advise on what to do next. Sounds like a episode of Cops around here. Yes, bad things can happen, but how often is an American arrested for living with an illegal alien, really? Especially when no fraudulent intent is involved? Where's the fraud here OJ, show me the fraud. Loss of citizenship would be based on fraud with her own green card and naturalization, not someone elses. Loss of citizenship? Please.

Even so, there isn't much you can do anytime soon.

First of all, you aren't married, so you can't do anything unless you are or at least intend to marry. If you do decide to marry, you'd have to start by filing an I-130 immigrant petition for him. Under current law, he wouldn't be able to adjust here in the US, he'd have to go home. It will take a year or so just to process the petition and have it sent to Brazil. Same thing if you filed a K-1 fiance petition. At that point, if not before, he'd have to leave to do an immigrant visa interview. He'd be turned down, since he's been here illegally, a 10 year bar at this point. and he'd have to apply for a waiver through USCIS. That can add another 6 months of processing time. His chances of getting it are pretty fair, as long as his illegal stay here is his only immigration problem. But altogether you're talking about 2 years or more from the time you marry before he can get an immigrant visa to return, assuming everything is approved.

So, at the moment, he could be deported, but he knew that when he came here illegally to begin with. That was true from day one. There are possibilities anyway, but it will take a lot of time and effort to put the pieces together with no absolute guarantee that it will work.

GeorgeL gave you a great answer. Marry him and then petition him. He'll have to move back to Brazil and it will take close to 2 years, but he should be able to return eventually with a valid visa.

There's no "other" way to do it.

As an ILLEGAL ALIEN, there is nothing you can do to legitimize him. He needs to leave the United States immediately. Then you can apply for him as a fiance K1(there is nothing to let a boy friend live in the US) and marry him within 90 days or move to Brazil, marry him there, and then apply for a K3 visa.

But he already has a ban on him for entering the United States legally; for his ILLEGAL status in the United States. The longer the stay, the longer the ban.

If you are harboring him and aiding and abetting his ILLEGAL status in the United States, you are jeopardizing your Naturalization. Immigration fraud can result in the revocation of ANY immigration benefit.

There is really nothing you can do for your boyfriend in getting him to stay legally in the USA. He is an illegal alien and needs to go back to is OWN country. You are right, he is subject to deportation at any time. I am sure you would be welcome in Brazil.

He is an illegal alien, and there is no way to "legalize" an illegal alien. He must depart or be deported, and he will be barred from reentry for 10 years.

You cannot -- and must not! -- make any attempt to "help" him. If you do, you can be charged under the law which prohibits "harboring," "sheltering," "transporting," etc, any illegal alien and sent to prison for up to 10 years, plus $250,000 fine. And as a naturalized citizen, you can be stripped of your citizenship and deported as a convicted criminal.

Either dump him or move to Brazil with him.

He needs to leave and you can apply for a fiance visa or he will be barred for 10 years if he gets caught.

Unfortunatly because he is already here, the only thing you can do is marry him. Than he'd have to go through the process of getting paper work thorugh an immigration lawyer/ you doing it by going to www.uscis.gov they will help you file for him once you are married, he may have to go back to brazil as a "punishment" but he'd get back in once he'd been investigated by immigration and the US embassy back in brazil, if he had no problems with the law there should be no problem. Go to www.uscis.gov there you can read up and learn more of what you'd need to do AFTER you're married to him.
