I've recently become engaged to my b/f of 2 years. We are planning to apply for out license on 8-8-08 and we'll have a confirmation of our vows Dec. of 09. I was hoping to alleviate the stress of a year and half of planning by eliminating the thought of his possible deportation within that period of time.
Here's some background: he entered illegally 3.5 yrs ago; was cited but did not report to his hearing for deportation and therefore has a warrant; has been LEGALLY paying taxes for the last 2 years; has no other criminal record; yes, we are very much in love!
What can I expect in this process? I was hoping things would be "cleared" within the year and a half so we can plan stress-free and plan a honeymoon but I've heard so many various things, I don't know what to believe!

Well, there's no way for him to avoid going back in order to become legal and return, that part is true. If he had a deportation hearing scheduled, then he was ordered deported in absentia, and is subject to arrest, detainment and deportation if he's unlucky enough to zig when he should have zagged. Or, you never know when things are about to go completely bad until they do.
What you'll need to do is marry him and file an I-130 immigrant visa petition on his behalf. It will take USCIS at least 6 months and quite possibly more to simply process the petition and send it to the National Visa Center for several more months, and then out of the country. If your fiance is Mexican, it will be sent to Ciudad Juarez, since they handle all immigrant visas for Mexico there. Your husband would be ineligible for a visa, since he's been living here illegally and apparently has been ordered deported. So, he'll be turned down. However, you can file a waiver application for him through USCIS which has its own office in Juarez. If he gets the waiver, he'll be able to return, get a green card and live and work here legally. If not, he won't, but at the moment, it's his only chance to work it out.
Better to get this started before he gets picked up than after. Of course, maybe he won't, but that sort of thing is very hard to depend on. Considering his various problems here, it wouldn't be a bad idea to get an immigration attorney to help walk you through it and help with the waiver request. But this will take quite some time, a year or more easily. |

The fact that he got an order to deport yet did not follow it definately creates a situation where he may have a permanant bar from visa eligibility, and he may not be able to ever be here legally even though you married him. At a minimum, marriage in itself will not solve much, because he would still be held responsible for unlawful presence, which makes for an automatic ten-year bar from visa eligibility. A waiver is available for unlawful presence, but no waiver is available for pending deportation.
TRUST ME HERE and consult with an immigration attorney BEFORE getting married. You might love him, but love is not enough to overcome the stupidities of immigration law. |

None of the part after "entered illegally 3.5 years ago was cited" matters one bit.
Here is what you are looking at:
He will eventually be deported, of course this will be after you have a few kids.
You can't start the visa or green card process now that he has screwed up twice (entering and then refusing to leave).
When he is deported he is looking at a 10 year ban minimum so kids grow up without daddy.
Not a very nice future. Are you sure you want to make this lifetime mistake? |

Well he currently has a failure to appear and as you stated a warrant for his arrest. This guy sounds like a real winner. Eventually he will be caught via traffic violation etc and probobly deported............we can only hope eh. |

Wow, you're truly screwed. Your boyfriend has an outstanding order of deportation because he chose not to show up for immigration court. Should your boyfriend be encountered by any law enforcement agency, he will be turned over to immigration for deportation. Also, ICE has fugutive operation teams throughout the US who look for people like your boyfriend. Your best bet it to find a good immigration lawyer, who can file a motion to reopen your boyfriend'scase, which he is not likely to win because he knew when and where to show up and did not. Basically, you're screwed! |

If you continue to maintain a relationship,with even being married,he would still be required to return back to whatever country he is from,you then have to sponsor him to return. Just being married this does not remove him from all other condtions ,to come here. |

there is no way to prevent deportation if he is illegally in the country should ice pick him up. i would see an immigration lawyer immediately, and if you are really in love, it might be better to get married right away and put in the green card application.
the application could take 9 months to a year. then he would have to go back to his country of origin to finish the application process. |
