What citizenship will my child have if I am a US citizen and he is born in Canada?

I will be traveling with my husband starting next week and I am 8 months pregnant. I am not sure how long I will be there, but what if my child is born in that time? Will he have citizenship in both countries? If so, what paperwork does he receive? Birth Cert? What does Canada provide? Thanks!

We will be residing there, my husband has already been settled there for months. If someone can provide details to me that would be excellent.

Make sure you have insurance that covers the delivery. If your husband is already settled there on a work permit and is covered by the provinces' health care and you are coming over on a TRV to stay with him as his spouse, you will probably be able to get coverage under his policy and if you are lucky, he's in a province that would cover you right away. Some provinces do that when you come from another country and some provinces will waive the waiting time at least for pregnancy and childbirth.

If your husband is a PR or a Canadian citizen and hasn't sponsored you yet, you will not be covered by Canadian health care.

The child will be a Canadian citizen. Any baby born in Canada is a Canadian citizen unless the parents are diplomats. That goes for babies of citizens, PR's, temporary workers, students, tourists and illegals. Born in Canada = Canadian. Then you need to register the baby with the US embassy in Canada to get it US citizenship as well, see http://www.consular.canada.usembassy.gov/birth_abroad.asp

The child will be a Canadian citizen as that is still canadian law. BUT you MUST register the child with the US embassy ASAP if you want the kid to be an american. The embassy will issue a certificate of citizenship. Then you use that certificate to get the US passport. Without a passport the child CANNOT enter the USA.

The child will NOT be entitled to any Canadian benefits as the parents are NOT legal residents. (You are only visiting) . You will be required to pay the hospital bill - around $10,000 if you have your baby in the hospital. Visitors are NOT entitled to use the health care system.

I was born in Canada from US parents and was first considered Canadian, then my parents and to make me a US citizen.

A new law passed in Canada on the 17, though, which makes almost everyone in the world Canadian... Well, a lot more at least

He or she will be a US citizen, and can apply to be a dual citizen with Canada (it is not automatic).

Canada does not do anchor babies. If neither parent is a Canadian permanent resident, the baby will not automatically have Canadian citizenship.

You need to see a Canadian immigration consultant if you want proper clarification of this. Also make sure you file for US citizenship for the baby so they will be free to work in both countries. Dual citizenship is allowed.
