Illegal means against the law. Those aliens who are in the country illegally are illegal aliens, despite what the morons who state, "no one is illegal," believe. All aliens who entered our country illegally are guilty of a federal crime. They should be deported.
Apologists for illegal immigration like to paint it as a victimless crime. But in fact, illegal immigration causes substantial harm to American citizens and legal immigrants, particularly those in the most vulnerable sectors of our population-- the poor, minorities, and children.

Illegal Immigration is a Crime.
Under Title 8 Section 1325 of the U.S. Code, "Improper Entry by Alien," any citizen of any country other than the United States who:
Enters or attempts to enter the United States at any time or place other than as designated by immigration officers; or
Eludes examination or inspection by immigration officers; or
Attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact; has committed a federal crime.
Violations are punishable by criminal fines and imprisonment for up to six months. Repeat offenses can bring up to two years in prison. Additional civil fines may be imposed at the discretion of immigration judges, but civil fines do not negate the criminal sanctions or nature of the offense.

Illegal means: against the law, against rules. Regardless what the judge said, anyone with common sense knows : it's illegal (against the rules) to live in a country without documents (papers).

So is it illegal to rob a bank but not illegal to be a bank robber, so no arrest on that basis and I can keep the money? What's the difference? I just want a better life at someone else's expense, just like any illegal.

Illegal is just a shorter way of saying illegal alien--And that is a noun. It is not illegal to be human, but it is illegal to be an illegal alien. Being human does not give anyone the right to be any place they please any time they please. It sure gets tiring having to explain this over and over. But I know everyone gets it. Even the illegals and pro-illegals. They just don't want to admit it. |

HECK NO, every illegal should be arrested if they are known to be illegal....LOOK AT THE KEYWORD, MY GOD, THE KEY WORD IS ILLEGAL!!!! Ilegal used to mean something. I remember around here when you could be arrested for street racing your 69 Chevy camaro vs. that poor old mustang that choked down and wont crank. (Fun times...but that was when the US still had a 99% LEGAL population). Noone gives a damn anymore about everything illegal that is happening. The illegals come here and take food stamps and welfare that should be handed out to people that need them, instead these people come here and aren't here lawfully. In ALL means should the illegals be arrested. Some LEGAL people say that the illegals had a troubled life in their home country....I guess no one every walks the streets and sees all the homeless and poor people that have lived in the US ALL their lives and are therefore LEGAL citizens but they recieve NO help at all. Thats my opinion, I think it's a good one, Think about it. |

It is illegal to enter the country unlawfully. If they entered lawfully and overstayed it is an INFRACTION. It is still illegal in that it is unlawful, but is not what is generally considered a 'crime'. The consequence is deportation, however. If they came illegally across the border it is a misdemeanor the first time and a felony if done after deportation. Then it is illegal to be here, in anyone's sense of the word.
The fact is it is a lot cheaper to prosecute an administrative 'infraction' that does not have 6 month penalty possibilities because it goes to things like what 'due process' needs to be availed the deportee. It is also faster. So in the past, that is the remedy that typically was sought.
The judge may have been speaking of a specific situation where someone who never came before overstayed a visa, and may be choosing not to see it as a 'crime'. However, I suspect it isn't a very good judge, and that the judge will be overturned by better judges, on appeal. |

That's nuts. But liberal judges are wrecking Canada, too, by saying that it is cruel to put murderers in prison for life, so they must be released no matter what after a few years. Like Karla Holmoka. She's free as a bird after torturing and killing her own sister with Paul Bernardo. |

Its like the drug laws, its illegal to possess or sell drugs but they can't arrest you for being high on them (unless operating a vehicle) so I guess that is where he is going with that ruling. I personally disagree with it. |

You would be incorrect in your statement that illegals can't be arrested based on status. Any Peace Officer in the United States who has taken the 5 week ICE course and becomes 287g certified can make arrests based on immigration status. |

Remember that judges have to interpret the law exactly as it is written by congress. If congress writes that it is a misdemeanor to cross the border without presenting yourself to US customs, then that is exactly what it means and that is what the judge must rule.
The same rule cannot apply to everything. It depends on how the law is worded. Don't blame the judge for playing with the wording, blame the congressman that wrote the law. |
