If someone gets picked up by border patrol for being undocumented, they will receive a notice to appear. That notice will give the person a date to appear before an immigration judge who will decide whether to deport the individual or to grant them relief and allow them to become a legal permanent resident. This decision will be based on whether the statute provides the individual with relief from deportation. Relief is very limited and specific. Most people are deported. In this situation, people are generally detained until their court date. People are let out on bond, but it is expensive because unlike in criminal cases where you can put up 10% or so of the amount, the individual has to pay the entire amount of the bond. Often, undocumented individuals are considered a flight risk and their bonds are set very high.
If they are picked up by a regular police officer, it will depend on where they are as different cities act differently. Normally though, someone will not be picked up by a regular cop unless their undocumented status is coupled with a criminal act. In that case, it will depend on the police department whether they will contact immigration officials and turn the individual over to them. |
