What is worse unauthorized entry into the u.s. or unauthorized overstay?

like i said b4 my lawyer says its not about unauth. entry but unauth. overstay. my husband was never told he had to leave when his i 485 was dennied based on a 2 year skilled worker thing. the employer that was sponcering him filed bankruptsy and left town and immigration requested proof of 2 year skilled worker and didnt provide proof so thats why they dennied it. so i checked with immigration my self and all that he is not in the system for removal proceedings. so dince he came in illegally and went strait to a lawywer and got a case going and they never questioned his entry or if they did it was never an issue will it matter now? im trying to find out if he will be subject to a 10 year bar based on this information even tho my lawyer says it isnt about unauth. entry its unauth. overstay. but no records indicate he had to leave make sence?

also i read in the instructions 4 the avvidavit of support that i can use my husbands employment and income he will recieve from a job he has been offered to work in when he comes back in this form it states that the persom=n i am sponcering is concidered a household member and i can file an i 864a on his behalf as long as his income is comming from the same sorce what does that mean? does this mean he has to work for the same employer he was working with here b4? or can he get a new job? he has another company that wants to hire him when he gets back and they are willing to provide a letter of offer of employment and porovide what they will pay him. along with my current letter of employment and last year tax return is this correct?
