What will happen if my husbands Sponsor no longer wishes to sponsor him on k3 visa?

I want to divorce my husband but I know he wont agree, he just recently arrived in the USA on a K3 visa and has not adjusted status yet. I do not work so I am unable to sponsor my husband financially, I had a family member who was going to sponsor him for when he adjusted his status. If I ask this person they will no longer sponsor him. Will this work in my favor of not letting him adjust his status and getting him sent home?

You can file for divorce without his agreement.It is just messier and more expensive without his agreement. See a family law lawyer right away.

So yes, if no one will sponsor him and you withdraw sponsorship, he will have to leave the USA.

Just call immigration and tell them what you told us.

You should file for divorce before he gets this going or you might lose some of your rights, by the way.

If you fail to file the proper paperwork, or just don't show, he won't be able to adjust on his own, depending on how long you've been married. But, as noted, it could be quite a while before immigration gets around to sending him home, if ever. Of course, with no work card, and no place to stay, maybe he'll just go home on his own.

Edit: Actually, he's currently in status on his K-3 visa, so they can't deport him as he's here legally. You'd have to divorce him to sever the relationship to remove his current legal status.

It depends... Unfortunately, there are plenty of people that are living in this country illegally, so they may not necessarily send him back tomorrow. I would be careful... People that the government doesn't "know about" tend to exhibit violent and criminal behavior.
