When can I apply for US citizenship?
Find answers to your legal question.

When can I apply for US citizenship?

Hi, I have recently returned from the UK where I worked with my US citizen wife for 11 months and a half. I didn't return to the United States during that time and I know I'm not allowed to apply for naturalisation any time soon because I broke the continuous residency requirement. When can I apply for naturalisation with my marriage-based green card? In 3 years from now or only later?

Thank you for reading my post.

Since you have already abused the privilege granted to you I see no reason why you should be allowed to return

In 3 years less 90 days.

If you are applying based on 5 years as a Permanent Resident or 3 years as a Permanent Resident married to a U.S. citizen, you
may file for naturalization up to 90 days before you meet the continuous residence requirement. For example, if you are applying
based on 3 years of continuous residence as a Permanent Resident married to a U.S. citizen, you can apply any time after you
have been a Permanent Resident in continuous residence for 3 years minus 90 days. You may send your application before you
have met the requirement for continuous residence only. Therefore, you must still have been married to and living with your U.S.
citizen spouse for 3 years before you may file your application. You must also meet all the other eligibility requirements when
you file your application with USCIS.

In 3 years.

USCIS "Guide to Naturalization" says you can apply for naturalization 90 days prior to residing in the US for 3 years. So you cannot apply 6 months prior, only 3 months prior.

And I don't know what's up with you guys...all of the comments (except for Yak Rider's) have been mean so far, what's the reason for so much hatred on here....? Ian, he was allowed to return because he is married to a US citizen and abused no law. At least he did the legal thing, so what's your problem?

You start counting 3 years from now. You can apply US Citizenship after 2 years and 9 months from now and if you are still married to the same US Citizen wife.

Yak Rider
You can apply in 2 and 1/2 years from the date you came back from the UK. You're allowed to apply 6 months early.
