We (USA) are sending mixed messages when we don't do anything if they use false ID. The US Supreme Court made a decision last year that is very interesting. You have to prove they were trying to steal and not just trying to work in order to prosecute them for identity theft.
If they get caught crossing the border it is under the criminal code you quote as a class B misdemeanor and if they are not caught then it is unlawful presence and it falls under Civil statutes but most of the time ICE does not prosecute to the full extent of the law because it would cost the US more to do so. AZ SB1070 is interesting since it requires they prosecute to the full extent of the law. That is on the first page. If they would have been more careful in their drafting of the AZ law it would not be drawing as much attention but I printed off the entire thing (17 pages) and there are parts that will be abused and challenged as well.
You quote the law and as pointed out ICE does not enforce it, part of the reason for this is their hands are tied by the same law. Once someone is here unlawfully and not breaking other laws then ICE is limited in what they can do. They are supposed to have the persons name on a warrant or deportation order signed by a judge but they don't have most of these peoples names. They do have more authority when they are doing major raids on factories etc... and at that point they can take them into custody. A police agency that arrests someone that is undocumented is not supposed to hold them more than 72 hours without charges and many times ICE is too busy to go and get them. They don't have enough man power to do it. In my city we have 6 ICE agents and thousands of undocumented people. It is frustrating to the police and yet even when they are caught most of the time all they do is deport them since it is only a class B misdemeanor. If we want to use deadly force on the border we need to change the laws.
Illegal aliens using false social security numbers will not be charged with identity theft if they were only using the number in order to work.
