Why do people who claim to follow the constitution want anchor babies to be illegal?

The 14th amendment clearly states: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

Why do people that claim to respect and follow the law want to dispose of this? Those children by law are legal and citizens.

14th Ammendment
Section 1.
All persons born or naturalized in the United States,
and subject to the jurisdiction thereof,

(SUBJECT TO THE JURISDICTION : That Means To A U.S.Citizen )

No State shall make or enforce any law
which shall abridge the privileges or immunities OF CITIZENS OF THE UNITED STATES;
nor shall any State deprive any person of life, liberty, or property,
without due process of law; nor deny to any person WITHIN IT"S JURISDICTION
the equal protection of the laws.


"AND SUBJECT TO THE JURISDICTION THEREOF."

The whole problem is caused by the fact
that the meaning of this phrase,
which was clear to anyone versed in legal language in 1868,
has slipped with changes in usage.
Fortunately, there is a large group of court precedents
that make clear what the phrase actually means:

The Fourteenth Amendment EXCLUDES the children of aliens.
(The Slaughterhouse Cases (83 U.S. 36 (1873))

The Fourteenth Amendment draws a distinction
between the children of aliens and children of citizens.
(Minor v. Happersett (88 U.S. 162 (1874))

The phrase "subject to the jurisdiction" requires
"direct and immediate allegiance"
to the United States, not just physical presence.
(Elk v. Wilkins 112 U.S. 94 (1884))

There is no automatic birthright citizenship in a particular case.
(Wong Kim Ark Case, 169 U.S. 649 (1898))

The Supreme Court has never confirmed birthright citizenship
for the children of illegal aliens, temporary workers, and tourists.
(Plyler v. Doe, 457 U.S. 202, 211 n.10 (1982))

Last year, 92 Congressmen sponsored a bill
that would change (Reinterpret) the 14th Amendment
so that children of illegal aliens born in the United States
would not be granted citizenship.
The bill is still in committee.

You and everyone else knows that the law is being abused. It was not intended for pregnant women to purposely and illegally cross the border to have their little anchor kid in the U.S.

That means if you illegally cross the border, you aren't presenting yourself for inspection. Therefore, you disobeyed US law and aren't under jurisdiction. So, changing the law would hold up under the constitution test.

The 14th Amendment was meant to insure the children of African slaves became U.S. citizens after the civil war was over.

It was NOT meant for children of illegal aliens from Mexico or ANY other foreign country!

It has been abused for far to long and needs to be changed to prevent further abuse!

Because when the Constitution was ratified in 1868, the illegals babies were not given birthright citizenship. And for a long time the U.S. Supreme Courts agreed until they put PC liberals in there. Besides, no other country (except Canada and Mexico) allows non citizens or illegals babies birthright citizenship. So why should we keep allowing the misinterpretation of the 14th Amendment to continue.

if the parents are in this country illegally the child should be an illegal as well. the parents should have no legal right to any assistance in food, housing or education. you are right the kid legally is a citizen so deport the parents and you raise the kid!

They are but their parents may not be. If the parents aren't they should not be allowed to stay. They can either take the babey with them or give it up for adoption but not use the baby as an excuse to stay.
