My dad who recently became a permanent resident is petitioning me to become one. The problem is, I've been here illegally since 1988 (overstayed visa). Will I be able to adjust my status if and when a visa becomes available? I'm asking this question because my parents were also here illegally but became lawful thanks to my sister (a US citizen) who petitioned them. Would I be considered immediate family since my father is petitioning his son?

No, not unless you are under age 21 when the visa becomes available. Persons out of status who are not immediate relatives of
US citizens cannot adjust status. Immediate relatives are spouses,
parents and children of US citizens. |

No, since you won't be in immediate relative status whe your parents file for you. They were when your sister filed for them. On top of this, the petition they file for you will be an F2b, since you're now over 21, and the petition itself wouldn't be valid for about 9 years. So, you would have quite a while to wait. And, if you married while waiting for your petition that would invalidate the petition. |

If by adjust you mean looking over your shoulder every second of every day after they find out who and where you are, then I would say yes, you should be able to adjust. |
