Will I be allowed back into the US if I left on an expired visa but was not deported?
Find answers to your legal question.

Will I be allowed back into the US if I left on an expired visa but was not deported?

I am a British citizen and lived in America for over seven years and my visa did expire before I left. I was on an expired visa for 20 months, and left but was not deported. I am due to go back over this summer to visit my parents but am worried I will be turned down. Any advice would be appreciated!!

well all depends how long ago you left the country.. The truth is that before they didn't have a real way of knowing who stayed in the country or who left. That is why they are trying to take finger prints and using passports with chips... etc.
Before they would not get any info from you when you were leaving, except your I 94, The airline would ask you for it, That was the only way they would know you left. I know people that over stayed their visas and they could reenter. BUt of course that was before 911

Sidwell
there are stories of others who have overstayed in USA (often before 9-11) and when they attempted to reenter USA after 9-11, they were arrested at the airport, DEPORTED and BANNED from USA.

if you overstayed for more than 6 months, then the ban is 3 years.
if you overstayed more than 12 months then the ban is 10 years.

I hope that when you say "visa," you actually mean authorized period of stay as shown on your form I-94 (white) or I-94W (green) because the validity period of a visa has nothing to do with how long one can stay.

Presuming you stayed 20 months beyond your authorized period of stay, and you left within the past 10 years, you are inadmissible pursuant to section 212(a)(9)(B)(i)(II), unlawfully present for a year or more and voluntarily departed.

As Sidwell said, an overstay of one year or more results in a 10-year bar. It would be unwise of you to try to enter anytime before the 10-years expires.

I would check out the rules for visas and conditions of entry to the USA, as they are now turning people away more frequently.
