im a british citizen and come out to america last july to be with my american boyfriend. weve bin having problems getting money to get back to the uk to sort my visa out because people loosing their jobs. im pregnant aswell. my mom called the embassy up and they said i wouldnt be banned but i got to go to the embassy for an interveiw so they know why i overstayed.
is this true?
i need some help please.

Visitor or tourist visa holders are indeed banned for reentry from a period of 3-10 years depending upon how long they overstayed. This rule as far as I have heard is strictly enforced and not having enough money is I am sorry to say, a poor excuse. If you are a tourist visa holder, you are expected to have the means to travel. Staying after your visa has lapsed sends a signal to the USCIS that you intend to stay which is not a good.
You should have filed for extension to cover the second half of your five months stay. Extension fee is not that much.
If you get married and will be sponsored by him then you can legally stay as long as he has a job and his income meets the requirements imposed by the USCIS. Good luck! |

If you overstayed 180-360 days, you can be banned from reentry for 3 years. If you overstayed for more than 360 days, you are banned for 10 years.
As the other poster says, the only thing to do now is marry your boyfriend ASAP and apply for an adjustment of status.
Pregnancy doesn't have any effect on your ability to stay in the country, nor does lack of funds. |

Marry your boyfriend and have him hire an immigration consultant to get you legalized. ASAP. He needs to be over 21 to do this. |

Since you overstayed on your Visa Waiver Program, now you cannot enter to US with VWP ever again. You need to apply Visitors visa at US Embassy to come visit US. |
