Sure! If you are US citizen and your husband was inspected when he entered the country you can file for him without leaving the country. Overstaying is forgiven in marriage. He doesn't have to leave the US if he was inspected!!! Moreover, if he leaves he could face a 10 years bar to return here and this will complicate your simple case.
If he came without inspection this will be a different case.

Are you a US citizen? You can sponsor him for permanent residency status; however, he will have to return to his home country first, and re-enter under the marriage visa.

The million dollar question is:
Did he enter legally with inspection or he entered illegaly through the border? If he entered legally he could get a work permit in a few months and a green card in about 6 months.

If he came illegally the only option is for him to leave the country and get the 10 years ban and then file for a waiver so he could come under a green card even though the 10 years ban. Getting the waiver is almost impossible and then he'll have to wait until the ban is over and only 10 years later he could come to the US with you.

OR - wait for an amnesty law to pass. How old is he? when he arrived the US? how long is he in the US? tell him to enter to dreamact.info and check if he can qualify.

tonlacx say that he will have to enter on an immigrant visa but leave to his home country - if he entered legally he will have to leave and then he has a 10 years ban, if he enters legally he doesn't have to leave.
if he has a 10 years ban and you are not pregnant they he will not get a waiver to this 10 years ban and you will be stuck apart. That's the best advice you will get and a lawyer would tell you the same.

you can call your local immigration office or the applicable consulate as they can help. Of couse call from a pay phone so they don't know where you live and don't use your real names. but at least you can get some info.

Being the spouse of an illegal immigrant, you can help him if you sponsor him. He will not automatically be legal. You will need to file paper work in his behalf by filing a family based petition (wife petitioning husband) with the USCIS. The forms that you will need to download from the USCIS website are the following: I-130, I-485, I-765.

If you are a US citizen then the process should go quickly. If you are a green card holder then the process will take longer.

If he was inspected when he came in, meaning he went through a port of entry and he has a I-94 then good but if he crossed the border then you will file an additional paper work and will have to pay a fine.
