Someone we know had already started the immigration proccess when he was arrested for possesion on marijuana...the only reason he wasnt deported while in jail was because he had already began with the paperwork......hes been trying to get it dismissed but if the charges stick can immigration deny his application?

Yes, unfourtunatly Immigration will reject the application.
If they decide not to deny it it might take way too long before he is approved for it due to the fact that they approve people with clean records first.

They are very strict about drugs. The application won't go through and he will be barred from returning to US. He's finished here. |

Yes of course.
He shouldn't have been involved in ANYTHING illegal if he wanted to immigrate to the USA.
If they determine him to be guilty he will be denied I'm sure, the only reason they didn't deport him before is because he is innocent until proven guilty. |

If the charges stick then, yes, he can be denied and ordered back to his own country. Time to get a high powered attorney involved in his case if he wants to stay here. |

the only reason is not deported yet? is not because he has started his application,
he will have to be processed first trough court to determine if he is guilty or not.
