After being legally in the states for most of my life, my visa has now expired and i'm facing deportation. I been with my girlfriend for almost 1 1/2 years now and i'm considering asking her to marry me in hope that by marrying her the judge won't deport me. Don't get me wrong, we currently live together and i'm very much in love with her and she knows that. I'm planning on getting an immigration lawyer to represent me in court as well as some letters of character from people in society such my pastor, employer, school, etc. I'm extremely scare, because I'm afraid of being deported and loosing my family. I don't know what else to do. Please, any help will be greatfully appreciated. Thank you so much.

well you should not marry her to keep you from getting deported. go thru the steps to become a citizen then if you still feel that you love her for her and not what she can keep you from then marry her, if you do it now it will seen to her and her family and everyone else like you are just using her. get your citizenship first then go for it. it is not a good idea to marry her now (the wrong reasons) marrage is a sacred bond that should not be taken lightly,

No! There is nothing automatic anymore about 'marriage to keep person in the country'. I've been married to my wife for 4 years now, we married while she was still on a student visa, and we're STILL not completely through the naturalization process. Thanks to 9/11, the immigration process is MUCH slower, MUCH more expensive, and at any time, for any reason, the government may ask them to leave the country. (Yes, it even says this in the forms) Even after you get an actual greencard (most people consider this the final step) the government may decide that your marriage was 'not in good faith' and may ask you to prove that it was. This ALSO happened to me. It took another 2 months and pages and pages of documentation to satisfy them. If we failed to do this, she would have been asked to leave the country effective immediately. So yes, it's long. Yes, it's scary. and No, there's no guarantee of success. But documenting EVERYTHING, literally EVERYTHING and having a good lawyer can prove quite beneficial. Good Luck. |

Yes Sir, but you must first go through a series of steps in order to attain legal citizenship. Its gonna be pricey but you pay as you go. Lots of appointments, lots of information required on your part to submit to the officials. Its along process by you will manage. Your looking at a year and half to become completely documented. However, if you say you can afford an attorney, the process will be slightly faster but will still be a while. It will not happen overnight so be patient. After its all said and done there will be many doors of opportunity open to you. Hang Tight and remember and record the steps you had to go through so that you can direct others in the same situation, and encourage them to help others to help the rest of the Raza work their way into this society. I think you'll be okay. I know a guy who was 80 something, he married this lady who was about 50 to keep her from being deported. He went to my church and and was pretty close with my parents, so this is reliable info. The thing I don't know is her actual status in the US. One thing that I know is she only had a green card. But, I don't know if it was expired or not. You sound intelligent, go take the test for citizenship. |

There is paperwork you can file but you'll need to return to your country of origin for the hearings. Marrying her isn't a guarantee of anything.

If you came to the US legally, and have never entered illegally, you should be able to file for adjustment of status in the US. You're gonna have to fill out a waiver though of some sort for having been in the country illegally, and you will seem suspiceous, as a lot of people do think marriage to a US citizen will automatically give them the right to stay. As long as you can prove beyond any doubt that the marriage is bona fide, and that you have been together for a while, I wouldn't worry too much.. Just remember that marriage fraud will get you in a LOT of trouble, even after the marriage, and if this is the reason you're getting married, you will be deported and banned from the country for life. However, I'm assuming that you really do love the girl, and as long as that is the case, it's not something that a good immigration lawyer shouldn't be able to take care of.

If you entered legally and marry a United States citizen, then you can file for adjustment of status here. The process would be that your spouse will file Petition for you first and immigration will conduct an interview indirectly to determine if your marriage is genuine. If marriage is found to be genuine, then the petition will be approved. And you can file adjustment of status application before the judge. If such application is approved, you will get green card. All of this requires cooperation of govt. attorney. It also depends on how fast cases move in the immigration court where you live and what judges like to do with such cases. Good luck. |

What kind of visa did you have that let you be here 'most of your life' that has only just now expired?
Have you been served with a deportation order? Marriage while under removal proceedings is not a 'stay in the US for free' move.. the I-130 can not be filed until y ou have been out of the US for X time.
It sounds like you need an immigration lawyer, and you should discuss your plans with her, not on the internet. |

It all boils down to becoming a citizen of the U.S. The American Dream. What is wrong with your country? Why people are not satisfied with living in their own country? Why can't you take her to your country and marry her? You've only been with her for a year or so. Suppose the marriage doesn't work out, you get a divorce and that will be your free ticket to stay in the U.S. No hassle, no nothing, you'll be set. Don't marry her out of desperation. If you are so in love with her, take her to your country and marry her, then you both can work your situation out together (in your country). The way you want to do it , seems suspicious. I hope she can see the BIG LIGHT BULB over your head. |

SInce your getting an immigration lawyer, it's best to ask him. Some of us here just give suggestion with out any real knowledge.
Since I'm one of them, My impression is that unless you do it just right, it won't help. THe best way is to go back to your country, and marry her there. The judge might be sympathetic if you were engaged. Keep records that you have been living together for 1 and half years. It would help prove that you didn't get married just to stay in the US. If they ask if you over stay, tell him it's because of love.

Your long stay "legally" in the USA will give you merit.... an overstay.....means deportation, instead of fighting deportation a wise man (or woman) would leave! only an illegal alien would chose to try to circumvent the process!
