I came as tourist to this country a few years ago and met someone and got married. My spouse is American citizen by birth and now we have a wonderful American child that have never met his other family, my family. I overstayed because I fell in love. We have worked really hard and even when we had a newborn child with just 30 dollar for food that have to last for a week, we have never ask for any public assistance. We pay rent, taxes and paid our own medical bills.My child is the only one that has health insurance that we pay for, because we don't qualify for free. As you see I have learned the language and start loving this country because have gave me what I love most: my own family. I know I didn't do things the right way, and I'm sorry about it. Every one has their own and different story. Do you personally send me back home now?

thanks for all your answers. I just post the question to know a little bit more of people's point of view. I respect every answer but the one that says my husband should go to jail. So if my husband goes to jail, what are you thinking for my son a boot camp, juvenile detention? Who you think you are? God? maybe we need more people like you because I imagine you have NEVER done anything illegal in your entire life and none of your family members have either, because I guess you have turned them to police, right? and by the way you can't send me back to my country because there is path to follow to fix my mistakes. I gain residency 2 years ago and in a year i'll become an american citizen, because my family has some rigths, too. the rest of you don't get mad about it, as I said before I just wanted to know your personal point of view.

What I would do: If I were your friend I would personally kick you to go to an immigration lawyer if you can't be bothered to deal with it yourself.
You could easily adjust your status and could get a greencard. It would take some time and effort and some money for the various fees - though it will be more complicated than if you would have done it right away - but it could be done.
It is very stupid (sorry, there is really no other word for it) not to deal with this in a responsible and expeditious way.
Currently you cannot legally work and you could get deported any time. If you do the right thing and adjust status you could be easily be legally in the country and you could work. Why aren't you then doing it? You like not having a legal status or what? You think it's cool? |

what would you do to yourself? it's been possible for you to adjust status and get a green card since you married. if you haven't and you get picked up and deported, are we supposed to feel sorry? go to www.uscis.gov and go into the form section. check out the I-485 and read through the instruction sheet. it's not cheap, but you'll need to file an I-130 immigrant petition, and I-485 adjustment of status form and a work authorization request, along with some other odds and ends, all at the same time, so nothing goes astray. We don't need your apologies for not doing things the right way, and you don't need our pity. Now that you know, go do something about it. |

personally, i dont care what you do, but the govt is a different story, and the way it works is that you have to go back to your home country to apply for a spouse visa. |

Yes,you are in the country illegally.
You did not overstay because you "fell in love",you overstayed because you chose to do so.
You knew what you were doing and chose not to go the legal route.
If you are truly sorry,then you should contact a lawyer and get your status legitimized. |

Not only do you get sent back, but we put your spouse on probation for aiding an illegal and failure to report. You broke are laws, I don't care if you caught Osama Bin Laden, if you're an illegal you should LEAVE. (But if you did catch him and you wanted to gain citizenship then i would say you should be put at the front of the line.) |

Yes, I would personally send you back. Saying one is in love or has a child is still no reason to break the law. Your story is no different than millions of Americans, I do not feel you should be allowed to remain or to disrespect the laws. |
