Hi there, 11months ago I hit a car from behind, my fault though nothing broke on her car, just on mine. 11 months after, she did a claim, and now after they studied the case I will have to pay for a damage on her car. She must have damage the car and claimed it was from that small hit with no damage.
How many time you have to do a claim? Is that right?
I found this very unfair.

She could have taken the car for a MOT and discoverd hidden damage at the rear of her car Such as bumper mounts and the bodywork behind the rear bumper.

It is unfair!
I had someone go into me at some speed and i was stationary yet it went 50/50 because there was no witnesses.
Insurance people are a waste of time.
Also I dont understand why people lie about what happened in the accident, if it was my fault I would admit it. |

I think she has about three years. I had a similar accident when someone hit me from behind. The damage looked minor about £20 worth. In fact it was severe and cost £1300 to correct. I think that the damage has not been discovered until a routine service or MOT You are fully comp/ so why lose sleep on it |

If involved with any accident use a camera, preferably a disposable one, and take pictures of the immediate damage as well as skid marks if any. Then send the pictures to your insurance company when reporting the accident (keep copies in case you need to go to court). With no evidence contrary you have little defense against her claim. |

There is a statute if limitation from 1 to 3 years on a minor claim....Depending on the state.... That's why it is important to carry an accident kit with you at all times.....Consisting of
1) disposable camera
2)pen or pencil
3) note pad...
the camera is to take pics right after the accident
pen and pad to write the description of the accident and license # and ins.... If you had this you would be able to to present the court with evidence that there was no damage at the time of you accident with her... Also you always always always.. Call the police and get a report done regardless what the other person says.....That way you have documented proof that there was no damage...At this point its your word against hers... The court may take it in to consideration that the claim is 11 months old... So my advice is to fight it... |

I know it's too late, but in the event of a crash always take photo's, keep a disposable camera in the glove box just in case.
Then you have poof what damage was done at the time of accident, plus vehicle location in case police are involved. |

Contact your insurance company and let them know that post accident you did not see any damage to her vehicle. How much are they paying out? Perhaps the bumper absorbers were damaged, and she did not learn of the damage until the vehicle went through it's yearly safety inspection.
Your insurance company should be able to tell if it is related or not, and if it was fresh damage vs. old damage.
Most states of a Property Damage statute of limitations of 3 years. |

In some cases, there are statutes that give you years to follow up on claims - personal injury being one. In some cases you have as much as 6 years to claim! |

How ridiculous. There's nothing to prove she hasn't bumped it herself and is now making an attempt to get away with having to repair and finance it herself. |

I think it is 3 years , but you can question her as to why it has taken so long to claim. is it possible that she has reversed into something and is trying to claim off you fraudulently.
Ask questions you may find she drops the claim
