i bought a car a couple of months ago and sent the log book off to be transferd on to my name but after a couple of weeks the log book was sent back to me and was told that the previous owner was supposed to send it, we had that done but now the previous owner is saying that he has been fined because i sent the log book in late and is demanding money from me, can anyone explain if this is possible and if so can he ask me for the money or does he have to pay for it as he should have known that he was supposed to send the log book.

Firstly, How do DVLA know that it wasn't the previous owner that sent in the V5? You simply put your name and address on it and send it so they don't need to know who sent it.
Secondly, If the previous owner failed to do the job properly in the first place they only have themself to blame for the consequences. They should be thanking you for doing it for them instead.
Thirdly, the DVLA don't fine you for sending in a V5 late.
Sounds like a rip-off to me. |

Tell him any more correspondence should be sent to your lawyer as he is now dealing with it, that should shut him up as he knows he is talking BS. |

As the law stands, its the responsibility of the seller to send the V5 (log book) to the DVLA.
If for whatever reason the seller gave it to you and you got a fine without sending it off, THE SELLER is responsible for the fine. Do not give them any money. Its their own fault for not following the rules.
He will have to explain in court and will still get the fine.

Just a try-on. As the seller it is up to him to ensure that DVLA is told that he is no longer the keeper. Until he does so, he is responsible for any fines the car acquires. And you are not fined for sending the log-book in late.

WHOA !!! HE'S been fined because HE sent the doc. back late, its nothing to do with you.
On transfer of the vehicle he is supposed to give you the green tear off part and then HE has to sign and return the main part.
Tell him to get stuffed. |

Don't pay him, it is his responsibility to send off the log book to say he is no longer the keeper.

THE DVLA DON'T FINE - unless they are charging road tax - anyone can send the V5 in as they don't check signatures- anyway all you had to do was notify them that you were the new owner and they write to the previous owner to confirm. Tell him to get stuffed, when you sell the car it clearly states on the log book that the new owner keeps the small tear off and the previous owner (seller) returns the rest of the V5 to the dvla. |
