A car accident?

in jan 2003 i had a accident in my car , now myself and my passenger have been compensated for it , but i had my three yr old lad in the back , i didnt realise that he could also be compensated and he is showing signs of neck and back problems now .What i want to know is can i still submit a claim after all this time .....................................

I think that if it were me I'd let it go as one way or another the insurers WILL get their money back even if it takes the rest of your (or more importantly your child's) life to get it, as they may question your motives (as people have here) for seeking a second bite of the cherry so to speak!

Maybe* I am not sure where this happened. In most states the statute of limitations runs whatever the normal statute time is (let's say 3 years), but for minors it is after they turn 18. So it may still be a viable claim. However, will have a hard time convincing the insurance that it's related. These kinds of injuries manifest themselves much closer to the accident date than 3 years.

Anyway, I know of one state where the statute of limitations runs the same for minors as for adults, so you really need to call the insurance and check

Or do you really mean : i didnt realise that he could also be compensated and so i want some money three years on from the car accident despite it being three years ago and him being a growing and expensive boy.So i want some dosh and fast.

I would defiantly seek legal advice on this, before the end of 2006, you will still be within a three year limit. Good Luck, I hope you are successful in claiming for your son's injuries.

in britain minors can make a claim up to 7 years after they come of age, ie until they become 25 years old, not sure if u can claim for him

I think the time limit is three years but I could be wrong. You make the claimin his name but acting on his behalf or something as he is a minor. At least I think thats how its goes. Please seek urgent legal advice as this may be time sensitive. Why did your previous legal advisor not explain at the time of your original claim that this could be done? Sounds iffy. May need to report the bugger to The Law Society or something. Good luck and I hope your son will be okay.

they usually say you can claim up to 3 years after so it's been too long

Yes, you should be able to claim for up to six years after an event. You will need medical reports I expect you could start by contacting Citizens Advice Bureau.

Or a 'no win/no fee' solicitor could help. Good Luck!
