Yours. You were backing, they were not moving. Do you have back up lights? You are supposed to, which would have given you enough light to see something as big as a car behind you.
Just turn it in to your insurance company and tell them you admit fault, and they will pay out what you owe. |

You hit him. In any state that puts you at fault. You sre responsible for looking to see what is behind you, regardless of wether or not he had his lights on. |

Yours and you even say that in your question 'i backed up'.
If you were to say ' this car hit me from behind, while I was backing up', lets say to parallel park then it would be thier fault for not keeping a safe distance.
If your only excuse is that you didn't see them, again your fault. If you saw them and they came forward while you were parking, and didn't have thier lights on- thier fault |

Ultimately I believe YOU are responsible because you backed into HIM.... It is ALWAYS the moving driver's responsibility to make ABSOLUTELY SURE nothing is behind you when you begin to back up....there SHOULD have been enough light emitted from your BACK UP LIGHTS for you to see at least PART of the car behind you prior to actually backing up... |
