A company car hit me and is giving me a check for the damages, can I go through my insurance company?

The check was made out to me but its not from thier insurance company its a personell check from them. My insurance company knows who hit me and said they will fix it but I have to pay the deductible. Can I take the check from the company that hit me and have my insurance company fix my car?

You can but you run the risk of getting caught. Because there is a chance after your insurance company fixes your car, That they will try and recover there money from the guy that hit you. So when they sue him and he produces a check made out to you that you cashed you may be in hot water...............md |

Well, you can, but it will backfire. See, you can't "double dip", legally. What your company is going to do, is contact them and say, hey, you did the damage, you need to pay us back what we paid out. Then they're going to say, no, we don't, because we ALREADY paid Joe! Here's a copy of the cancelled check. Then, your insurance company is going to contact you and say, hey, you owe US that money. And then, even if you pay them back, they're going to non-renew your policy.
So it's a bad idea to try to play that one. |

You cannot collect twice for the same damages.
Otherwise, you company fixes the car, and tries to collect from the other insurance company. The adjuster for that other company calls for a statement, and finds the insured has paid for the damages directly, and you get a VERY nasty call from your insurer, and accusations of attempting insurance fraud.
If you have accepted the cheque, the matter is legally done, if you try to get the repairs through insurance, and also cash the cheque, it is a blatant attempt to profit from the accident. |
