Providing he has insurance then his insurance company will pay for the repairs/ replacement vehicle. They can't get out of the third party liability section even if the driver was drunk.
If he does not have insurance then you can claim from the MIB - motor insurance bureau under their 'uninsured drivers scheme'.
You will have to advise your own insurance company of the incident (policy terms) and if you have legal expenses/ uninsured loss recovery insurance I advise contacting them as well. |

Assuming he is insured yes and if you are fully comp your excess. They may well refuse to pay for his repairs and could sue him for their outlay if he was drink driving. If you are fully comp I would let your insurance deal with it after all that is what you are paying the premiums for you mighr as well get them to earn them |

Your insurance company will take care of getting the money from him - call your insurance, give them the information and police report, and they will take it from there - they don't want to get stuck paying for it! |

If he has insurance then yes they will pay for it... if not if your insurance covers under insured or no insured motorist then that should cover it to. |

ABSOLUTELY! And, even if he isn't insured, he will have to pay out of pocket. Or if your state has the "No Fault" rule, (I live in NY) then your own personal insurance company will claim "no fault" and your car will be paid for by your insurance company. |

If you have comprehensive insurance they will handle this. They will pay out initially and attempt to recover from the drunk's insurers or from his own wallet. If you are 3rd party only you will have to do the suing yourself. In either case you will be offered much less than you deserve and will have to take action to recover the extra costs. Suggest you contact a no win-no fee solicitor for advice |

His insurance company should pay. Contact your insurance company for advice. If he is not insured there is a scheme funded by insurance companies here in the U.K which covers claims against uninsured drivers. I believe on average about £30 of everybodies car insurance premium goes towards this fund so we're paying for uninsured drivers anyway! Citizens Advice may able to advise. Good luck |

tell your insurance company what happened they will send you a pack out...try to get details times location etc.. a photo is a good idea too...several if possible...the insurance will fight the case for you..and with luck hire you a car while yours is being sorted...if its a write off..they will advise...is his car still there get photos...make sure you get the number plate...bad luck....hope it works out for you.... |

The insurance will pay you because you its not your fault and don't have to any excess. The drunk drivers insurance won't have to pay up because he was drunk and instead they will get money from him to pay the cost of your car.
By the end of the day you and the insurance win and the drunk driver loses. |

Depends on a few things.
What sort of insurance do YOU have. 3rd party, or fully comprehensive and was he insured.
Even if his insurance was invalid for driving whilst drunk, his company will still have to pay up in the UK. Even if someone is charged with drunk driving, they are NOT charged with 'having no insurance'.
If you don't get anywhere, a civil suit for damages to personal property through small claims court can force payment at a negotiated amount. |

yes, as long as he's insured. if not, i think u would have to claim through your own insurance.
any doubts, speak to your insurance company or the police. hopefully it won't take too long to get the police report, but there again, it's a busy time of year for them - loads of drunk nutters on the roads.. |

Yes, in California his liability will pay your damages. If he has no insurance, then your uninsured motorist coverage will pay up to $3500. If you have comp and collission, then your company will pay for your car, less your deductible and then your insurance co. will try to collect from him later-(subrogation). |

get a police report then get it to your insurance let them worry about collecting from the drunk if you have full coverage they should pay if you dont have full coverage go to the police and get the information of the drunk so he can pay |

probably not i'm afraid as he is drunk in charge of a vehicle and that invalidates his insurance as he is unfit to drive.
two options, if you are fully comp, claim on your insurance and let the insurance company claim the costs back, secondly let the insurance company fight it out for you. the second option may take some time becasue of the legal wranglings as he was drunk. |

in the normal, yes
one exception to the rule, if by some very stupid chance, he says that he deliberately ran into your car, they will not pay. insurance pays for accidents. |
