She hit my car said that she was going to pay so we didnt file a police report. Now she wont pay. I want to take it to court but I dont know if I will have any chances of winning because we didnt file a report. Has anyone been in this situation.? I think I have very little chance of getting any money what do you guys think?

Hopefully you have full coverage on your veh,Basically,Collision but if you do you will most likely have a deductible to pay If you make a claim with your ins co.ranging from 100 to 500 to 1000 depending on your policy.You need to obtain a damage estimate 1st if it's less than 500 I would pursue Thur court.If above that amount and you have coverage it's not to late to create a claim,however your ins co will most likely want to know why you didn't make a claim to begin with.Just advised them of the truth.if you have a full coverage policy on your veh your ins co.will pursue getting your deductible back along with their money they had to spend on repairs of your vehicle. |

Some friend! Talk to a lawyer. They usually don't charge for a phone consultation. Hopefully, there were witnesses. You can always take it to small claims court and represent yourself. It's not like it's going to ruin the friendship. Next time, file a report so insurance will cover it. |

I would still report it to your ins company if they call he and she dumb enough to admit to it, and she had ins depending on which state you live in she still responsable, other wise try yellow pages free consultations maybe you can get a lawer to write something up to scare the crap out of her to fork money over. |

I had the exact same thing happen to me. I just bought a truck, had it for only 2 weeks. I went to pass him and he fell asleep at the wheel and drifted right into my passenger side front door. My friend told me that he would pay for the damage out of pocket and 4 months later, nothing. I told him I was going to take him to court and had the money in two weeks. Not to say that it would turn out the same for you, but I also had a whiteness. |

If you know who her car insurance is with - just call them and file the claim.
If not - and you have full coverage on your vehicle - file the claim with your insurance company and they will pay you for the damage. If it is her fault, your insurance company will subrogate her (go after her for re-payment).
If you insist on going to court - contact the local clerk of court for small claims or magistrates court and file a small claims suit. No attorney is going to take a property damage only suit. |

this does happen alot dude. If this happened on your property the local pd can not really do anything.If you get at least 3 estimates this will also help,you. Call your insurance and let them know your problem. Do you still talk to him/her? I am guessing no.
If she does not want to pay or claim it on their insurance,take them to court. also look into as many lawyers as you can.the more lawyers that hear your case the less she can choose from. Have your car repaired, hang on tho the estimates and sue for the damage. keep in mind if you claim it on your insurance before going to court your rates may rise in price.
Your car would be fixed, your still having to pay a higher premium on account of their carelessness and stupidity |
