I would file a police report ASAP!!! You should have done it when it happened. If you have any proof too, that would help. |

I think your best bet is to call the police and make a report. They will go after him and you then have a record. You then could take him to small claims court. The problem with that is you will win the judgement, but if he doesn't pay, there are no teeth in the law. If all else fails go to your insurance company, you will have to pay the deductable, but they will go after him for the rest. |

Should immediately contact your insurance company and if possible file a police report. It may be too late. If he was an independent then the insurance company can get better results. If driving for a company, they have insurance. Evan as an independent he is required to carry insurance. All the more reason to get the police and insurance company involved. |

OK contact your local police dept and file a report. see if you had witnesses as well. then call your insurance company and let them know and give them a copy of the police report... make sure you have the name of the driver and his phone number ,licence number and licence plate number as well as the name of the company he was driving for.your going to have a deductible on your insurance more than likely so make sure home depot adds this amount in to the final cost to repair the damage...then you will not be out of pocket . his insurance company will foot the bill. stay on top of it but don't contact the driver only go Thur the insurance company's... let your company do the fighting for you . its their job not yours... just get them the information they need to fine this man and his insurance company...

ps: if he knocked down cable wires then the electric company had tocome out and fix them so there you have a witness . sow the police a copy of the paper work from the elect company... it will be dated and fixed on that day... also if you have photos of the truck and downed wires this is good too. proof. |

OK, well, you're going to have to sue the driver in small claims court. So you'd better file the police report pretty soon.
You ALSO might want to sue the OWNER of the truck - it might be someone else. |

If you didn't file a police report at the time, then you can just eat the replacement cost because now it's just your word against the drivers. |
