Accident caused by driver using parents car w/o permission.?

I was middle car of five. I did not have uninsured driver insurance. Claim denied by parents insurance as driver did not have permission to use vehicle. Now no vehicle and no compensation. Dollar value is more than allowed in small claims but not enough to pique the intrest of attorney. Looking for alternatives.. Appreciate any assistance

you can take them to court and if you win then the insurance has to pay under a clause called absolute liability
also your insurance should be able to collect from the driver behind you as they can be classed as following too close and they hit you regardless
even if the dollar amount is more than small claims you can still collect the max and costs in court |

It's true that the parents are not responsible for your damages as the owner of the vehicle because the vehicle was taken without permission, however they are liable because their child, a minor, caused property damage to you. Parents are responsible when their minor children damage or injure other people. So I recommend you take them to small claims court and sue them for the maximum amount allowed by that level of court. Of course if the child has reached the age of majority then the only thing you can do is sue the driver. |

Insurance follows the car, not the driver. The parents are responsible. Since there were five cars damaged, according to your description, your chances of getting much insurance aren't too good, especially if the parents had minimum limits, like $10K.
By the way, uninsured motorist coveage isn't that expensive. |
