Admiral car insurance and the case of the missing points.?

I've been with Admiral car insurance since 2004. Each year i've pretty much let my insurance automatically renew. In 2006 i got 3 points on licence for a speeding offence (my 1st and only). I believe I let my insurance company know of this, but I cannot be certain. These points have now expired as it was over 3 years ago. I got my renewal through the other week and decided to switch insurance companies. I phoned Admiral to let them know this. They said they would try and match the price. They went through the details of my existing policy. When they asked about points on my licence, I said "no new ones, other than the ones you already have on record for me". The girl search the database and found no record of this. Instead of matching my price to the other quote she then said I owed them over £200 for all the 3 previous years policies which did not have these points on. Obviously I was a little shocked by this. I have now switch companies. Admiral still insist I owe them this money. This is despite all of the insurance policies expiring and me never even making a claim. I want to know if they can ask me to pay more for a policy which has already expired and to which I have never even claimed?

Going by your dates you still have those points and yeah you might owe them the money but they won't be able to do anything about it.

I think you might not owe them the money.
If you had been in a crash you wouldn't have been insured, so why would they want money for providing no cover?
Anyway, points in the UK last for 4 years so if you got them in 2006 you still have one year to go.
Let your current insurer know or you might as well stop paying for insurance altogether as you aren't insured.

You shouldn't have said anything as the points had expired, just ignore any phone calls or letters, I doubt they'll follow up

There are, of course, two points of view.

To the insurance company you failed to disclose material Information (The speeding conviction) and had they known about it they would have charged more for the risk. TIP - always advise insurance companies by e-mail or letter and keep a copy. Although you never claimed, the insurance company would have paid any claim you did make. In theory they could regard you as having sought to obtain a pecuniary advantage by non-disclosure of the conviction. (A criminal offence under the Road Traffic Acts)

Of course, the response is that had you know that the premiums would have been substantially higher you would not have renewed the policy with the insurance company in the first place! BUT

The fact that the contract has expired does not absolve you of the duty to honour it during its existence - and one of the conditions is that you disclose all material facts at renewal. You have broken the conditions of the contract and the insurance company can sue for their loss i.e. the premium they should have received for providing the cover.

Doesn't sound kosher to me... ask a lawyer and you may be able to sue them for harassing you
