After an accident how do I make sure I'm not getting ripped off?

A friend of mine was in an accident last month. It was listed as a "no fault" accident. The officer said that if the damages were under 1000 then no police report needs to be filed, and each party can settle this among themselves. Sounds good right? Well the other party called and said "I need $900 by Sunday or I turn this into my insurance". What are the options? This happened in New York State.

So...turn it into your insurance. duh.

That's what insurance is for.

Then your friend can turn around and file with his own insurance too.

Then the two companies do their own investigations and determine fault.

"I need 900 by Sunday or I turn this into my insurance".....what does that goof think the insurance company will do? Send over a goon squad to break your friends knee caps? Get real.


New York is a PIP state. "no fault" is a type of injury coverage. Living is a "no fault" state does NOT mean accidents happen an it's no ones fault.

PIP (aka "no fault") pays for your injuries when you are hurt in an accident. It pays regardless of fault. In a "no fault" state the injured person HAS to file against their PIP coverage. IF they "break threshold" then they can file against the at fault person's bodily injury liability coverage.

So....tell your friend to call his insurance company and notify them of the accident. Then when the goof calls back....your friend can give him the claim number/phone number and name of the adjuster handling the claim. Let the insurance company handle it. That's what they are there for and believe me....NY adjusters know how to handle claims with this type of goof ball. An experienced NY adjuster has probably seen it all.

If it was declared a no fault accident they have no legal standing to demand funds. Did you get a police report? If you have a police report that states it is a no fault then let them turn it into there insurance and let them work it out. If you have no police report than I would get an attorney.
