If your beater is only worth $1500 then that's all you are entitled too. A lawyer can't change that fact (and he will take $495 of your $1500 for telling you the same thing). Your only hope of a higher settlement is being able to prove your car is worth more. This is only possible by using other cars for sale as much like yours in condition and mileage as possible and comparing the asking prices to what Allstate offered you. If you can establish the 'market value' as higher than $1500 then you have a shot. Threats, shouting, crying, etc. won't phase them.

Insurance is ACV (actual cash value) of the vehicle at the time of the loss. If $1500 is approximately what you could have sold the car for just before the accident, then it is a fair settlement. Sorry.

Dude you are kinda screwed. You can take the part of the money and keep the car. But, you are still left with a POS. So, good luck.

sorry man your kinda sol. A insurance company is only gonna give you what they think that car is worth. They go by miles onand the year of the car and what the overall condition the car is in. Trust me i totaled my 1997 sunfire i still owed about 5000 for the car and the insurance only paid 2,200 of it so now I'm stuck with a payment on a car i don't own anymore.

if you were driving a beater and they want to give you $1500 for it i say take it and run! to find another car try http://sfbay.craigslist.org/ . my Lincoln town car engine just went and i was able to buy a very clean 1990 Chevy celebrity with low mileage for $1200

I'm not sure what you think is the problem: that they didn't give you more than your car is actually worth, or that your car was worth so little. If you think your car is worth more, and you can gather some data that proves it, you can protest the settlement. You could get a lawyer, but it'll probably cost you more than the car is worth. You might to just settle for what you can get.

If that's the current listed value of your car in the condition it was in before the accident, and your policy isn't for replacement value or an agreed amount, then it's what you signed up for. All these other options would have solved your problem - but you'd be paying higher premiums.

My wife got rear ended and totaled my old van. I did not agree with the first settlement payment. I searched for an identical vehicle to replace and the money that would cost to replace it. The insurance company did come up with more money. You got to remember that is there job to low ball you at first to save them money. In my situation I did not have to get a lawyer.

So find an identical vehicle and tell your insurance company how much it would be. There second offer will be higher. I don't think they will come up with the total amount. It will be higher.

A total loss is a financial concept. It doesn't matter what you want, it matters only what you lost.

If your car was worth more, then you should refuse to take the money and start to sue them. Sue them as fast as you can, with as sleazy a lawyer as you can find. That will usually work.

If your car was only worth $1500, then you better take it.

allstate is a bad car insurance company.
