Alright so my friend is backing out of a friend's driveway and he hits a truck directly behind the driveway?

the guy left his truck by the curb the whole night and had plenty of driveway space.. could this situation get turned around onto the guy with the truck at al??

the one backing out of the driveway is always "at fault" no matter what, its the drivers responsibility to look behind him, if the truck was directly behind the driveway then that would mean it was just on the other side of th street so obviously the friend doesn't know how to back up, either way its the one backing up thats "at fault", why would it of mattered if the truck owner parked on the driveway or not, he has every right to park on the street like the rest of us, i always park my truck on the street when we have enough driveway space, we have a single wide driveway so im not going to keep moving it back and forth or move it at night, i just keep it parked on the street, either your friend doesn't know how to back up or he was distracted while backing up so either way its your friends fault

Your friend should have watched where he was going. He hit a stationary vehicle. Your friend is 100% at fault.

Your friend hit a stationary vehicle. It is perfectly legal to park on the street as long as you are within a certain distance from the curb. Sorry, but your friend is completely at fault, and is liable for any damage.

No. The person backing out of a drive way or parking space is always liable. An Insurance company won't pay you for any damage your vehicle acquires. They may pay for the damage you inflict on another vehicle, this will raise your premium, but no, there is no way to turn the blame on the person whose vehicle was parked on the curb.

no. the owner of the truck could have parked a mile away? it doesnt make any difference. the person backing up is 100% responsible

Probably not, especially if the truck wasn't moving. When you're backing up, it's your responsibility to check behind you to make sure you're not going to hit anything (or anyone).
