I was drinking and I passed out in the back seat of my friends car. While he was driving home I woke up and grabbed his shoulder. He was so surprised and scared that he drove into a parked car and totaled his Civic. What should I do?

In all logical sense you are 100% responsible but in legal terms probably not because you are just a passenger. |

quit drinking. Ride with friends who can drive and let his insurance deal with it. |

No. You are not at fault. Your friend, scared or not, should have been able to control his car. Since your friend was driving it is HIS fault.
There is nothing for you to do. If the insurance company calls you just tell them the truth and what happened. That's it. Your not in trouble. |

Technically you are responsible but your friend was the one driving so he is responsible. Stop drinking. If you pass out then you are drinking way too much. Let your friend's insurance handle it. |

you are obviously at fault, a distraction of the driver, especially while intoxicated is illegal and he could technically charge you, however since he's you're friend he probably wont.
the best you can do is asses the damage, pay an amount that you can afford. if you cant get a summer job and take a small cut out of your weekly cheques and give it to him to pay for the thing - depends on if you're close friends/want to keep the same friendship.
he might also be really cool and not want you to pay at all.
