Please don't answer this if you don't know anything and are just trying to score easy points. Additional Details Also, it's a 1989 Celica, WAS in good condition. I got an estimate for $3089 from a shop. Allstate is offering $1220. They sent a second adjust out and this increased it from their original quote of $1069. He said "Don't worry about the "number", it doesn't matter." But if it's this near to being totalled, I want it totalled rather than drive and later try to sell, a vehicle that has been wrecked (while it was parked).

It kind of depends on the age of your car. If it is a relatively new car, you should be entitled to seek new parts. If it is a few years old, and they can find good used parts of the same age as your car, you probably have to accept them, as they are the same parts as the damaged ones. It becomes stickier with aftermarket parts, because sometimes the quality is suspect. Have you asked your insurance company about it? There may be different laws in different jurisdictions, but I do know here most repairs are done with used parts and that is permissable in our laws. |

have an attorney write a letter. it may cost you a few bucks if you don't know one but well worth it.

I personally have State Farm insurance and they use "used" parts. But, the parts have to be accepted by the body shop. Mine rejected part after part. If no suitable part can be found they have to use new. I think more importantly than what insurance company's car hit you, is what insurance you have, and what body shop you use. Good luck! |

If your car is more than a year or two old...yes. You are entitled to have your car repaired to the condition it was before the accident, not to a better condition.
Let's say your car is 5 years old. You had a 5 year old bumper. You are not entitled to a brand new bumper, but rather, a 5-year old one. Now, they can't just pick an old part out of any used junkyard and use it. The parts they use are re-conditioned and 'like new.' You won't even know the difference.
And were you to present the claim to your own insurance company, they'd offer you 'like new' parts as well. It's an industry-wide policy. |

I don't know what state you are in but usually the insurance company will ask you to send them 2 or 3 quotes as to how much the repairs will be and they'll offer to pay you as much as the cheapest one. I believe you can ask that they use new parts but I can't honestly say if all states let you request them. i live in Virginia and they do allow you to request new parts. |

Absolutely. Your welcome to use new parts... but you will owe it out of pocket. Your vehicle is a used vehicle.. hence it can get used parts and be in preaccident condition. THey arent gonna throw parts on there that arent in perfect condition- you will never notice the difference.
Think about it... why shouldnt an 03 car get 03 parts if they are in perfect condition?
P.S. I am extremely surprised at all the wrong answers here... they must not be educated in what they are talking about. Mark my word.. there is no getting around it... they have the right to use used parts. Im sorry you are getting such bad advice on here... |

An 89 Celica is an old vehicle. You will get used parts. You do realize that used parts are the same as what is being taken off your vehicle.
You can insist on new parts but you will be paying the difference in price. Many companies now will put used parts on a brand new vehicle. It just depends on whether they are able to get them or not. |

No you do not have to accept it. You have the right to be made whole, which means your car was not made with used parts, and you do not have to accept a car repair like that. Just for your information: I had someone's insurance who fixed my car like that, and I didn't know it. The paint does not stay on the used parts that are used. Fight tooth and nail and tell them he11 no. You have the right to get it fixed where you want how you want. |
