17 October 2007 20:10 GMT - New regulations on driving and smoking are not fully understood by the public and little effort is being made to comply with them, claims a new report.

The law, in operation since July, requires that vehicles should be smoke free at all times if they are used to transport members of the public or are used in the course of paid or voluntary work by more than one person â€“ regardless of whether they are in the vehicle at the same time. The vehicles must also display no smoking signs.

If you have an accident and it can be proven you were smoking I think that they are more likely to be able to get a conviction against you for not paying enough care and attention, if that's what its called. mind, that's just what they were saying on the news a few months ago so not sure whether its law or not??

It is not actually illegal but if a cop feels you are not in proper control of your vehicle you are still in for the high jump

I'm sure a couple of months back, the highway code was changed to make smoking while driving illegal. I remember hearing it the news. It is ilegal to eat while driving I think, I remember a girl went to court over eating an apple while driving. Of course this is just the driver, not your passengers!

you are allowed to as it is private. If you are driving however, you do run the risk of being stopped for driving with out care and attention - but that doesnt happen often

There is no offence of smoking, eating or drinking in your private vehicle. You can, however, be prosecuted for not being in proper control, and it could be used against you in the event of an accident. That's why it's now mentioned in the new Highway Code.

Did you not hear of that woman, I think it was last year, who was done for taking a swig from a water bottle while stationary at traffic lights? A bit petty, but technically correct . . .

In the U.S. many States have prohibited smoking in your private vehicle if you have a child under a certain age in the car. It varies by State.

Its not illegal, but the cops can pull you over and class it as "dangerous driving" or "driving without due care and attention".

anything that distracts you from driving is potentaly illegal but i dont think they have got as far as smoking in private vehicles yet BUT ITS COMING ;-)
