It's snowing here in Virginia, and everyone has lost their minds... my little sis was backing out of a spot, and a minivan that was sitting in a line of cars threw it into reverse... the driver hit my sister's rear passenger door and bashed it in pretty good. Equal responsibility, or is one of the drivers at fault?
Additional Details
Perhaps I should have mentioned this was in a public college parking lot.

The person in the Minivan should have watched where they're going. That's what they invented rearview mirrors for. However, if the minivan was already backing out before your sister was, the accident was both their fault's. If your sister was already fully out of the spot, the minivan has all of the blame, as the driver should have clearly looked where he/her was going (via rearview mirror). If the minivan's rearview mirror was obscured, it would be a different matter. |

it sounds to me like the person that hit your sister is responsible but that's up to the insurance companies. |

From an insurance perspective, it's 50/50. Accidents that occur on private property (like parking lots) are not subject to the state laws (ever wonder why there are no speed limits in parking lots?)
To keep things simple and fast, the insurance companies of the two drivers will each pay for their insured IF they had collision coverage. |

As a general rule of thumb, if the car suffers damage to its back half, it's the other guy's fault, if the damage is to the front of the car, it's the driver's fault. There are exceptions, obviously, but this makes it easy for the police to avoid any detective and/or guesswork as to what REALLY happened. |
