Are Massachusetts auto insurance drivers eligible for "loss of use" damages?

The accident was the other person's fault, I didn't get the rental, used another car.
And if so, who do I call? The adjustors office, they're saying no - and maybe it's no, but their job is to get out of paying stuff so I don't know if they're blowing smoke.

Most companies if you do not get a rental and use someone Else's car while your car is in the shop or is un-drivable, will pay you "loss of use".
But the average is around $10 per day, since if in a rental, not only are they paying for a rental, but for the rentals cost of doing business, like salaries to the employees and other costs that go into running a business. So by using a friends car, there is no addtl expenses, so they will pay you something since it is cheaper to pay you vs a rental company.
But to be eligible, your car has to be in the shop for repairs, or un-drivable and more importantly, proven that the other guy is at fault and they have accepted liability. |
