The other driver agrees and it is stated in the police report that she was at fault. This is in Missouri.

By the way, this is not me. Asking for someone else. I would never drive without insurance.

Yes you can recover damages if the other party is at fault. Just because you do not have insurance does not mean you cannot recover damages in a loss that was the fault of the other party(honestly I do not know any state that says otherwise). However, just because the other party says they were at fault does not mean they were. That is for their insurance company to decide. So depending on the situation, the other party's insurance company may perform an investigation. This is where having your own insurance company comes in handy, they will perform their own investigation as well. But since you have no insurance company to back you, you may be at a disadvantage. |

You need to check the law for the State of Missouri. Some states have a law that makes an uninsured driver automatically at fault of any accidents they are involved in. The State of California, for example, has such a law. This is to "punish" people for driving without insurance. |
