At fault hit and run accident ?

My mother was out of town and i took my mothers car without permission and drove it to go and purchase something to eat. As i was making right turn i accidentally stepped on the gas pedal too hard and i lost control and swerved into the side of another persons car..i was so scared and i drove off. I was caught and a police report filed. i don't have a license and i never did
i'm 18 and the driver of the vehicle wrote a letter stating that she is taking me to a small claims court to sue for 1,300 of property damage....it was a 1998 mini van...she claimed that "my mothers insurance company would not pay for it" and the part i don't understand is that shouldn't it be her own insurance company paying for it and not my mothers?...what will happen at the small claims court? i plan to show up..but the problem is i don't have a job and i don't have the money to pay for it..i am Dependant on my mother and i am enrolled in college and she is already paying for me..with no help of my father, i can try and get a job and pay in monthly payments..but it will really take a while, i also have another court case for pending criminal charges..what will happen to me in that court? i'm very scared and i've definitely learned my lesson..but i need to know some answers..
also i live in the state of Massachusetts

You stole the car. If your mother wants her insurance to pay she will have to press charges against you. Most likely the other party does not have Unisured Motorist (UMPD) coverage or Collision coverage. Her recourse is to sue you for damages.
In small claims you will have judgement against you for the damages and possibly court costs.
In criminal court you will most likely be put on probation, you might have to pay a fine, and maybe even have to serve community service. It would helpful to try and get your drivers licsence and some insurance before your criminal court to show your 'trying to do the right thing'.

Well, dah, you steal your mothers car without a license, and wreck it. And, you think you will go scott free?! You better grow up fast, and say you are sorry. Go to legal aid and ask a lawyer.

You don't seem to grasp the concept of what is a wise decision and what is not. You don't need to try to get a job and pay...you need to GET a job and pay. You also need to start pulling your own weight and accept the fact your "deadbeat dad" isn't going to be any help. Step up and get your act together.

FIRST OFF YOUR MOTHER SHOULD HAVE UNINSURED MOTOREST ON HER POLICY. THAT WILL COVER THE ACCIDENT. bUT DON'T PLAN ON DOING MUCH ON THE WEEK ENDS YOUR BUTT WILL BE IN JAIL.

You are at fault in every sense of the word. I'm sure your moms insuranse will not cover it, for you were not on her policy (not having a license). You maybe really sorry and scared but thats not going to help you in small claims court. The lady you hit will show proof of the amount of damaged sustained in the ordeal and you will be held accountable to pay up. How your local authorities handle the situation is a whole 'nother issue. And if this is not your first offense with the law, I suggest you grow up because you're too old for your parents to bail you out as you are now an adult in the eyes of the law.....

Your at fault and you have no defense, I guess you should have thought of that before you took the car. Better get a couple of jobs and put off college for awhile. To bad.

The fact that you were driving the car without the owner's (your mother's) permission will certainly complicate the insurance issues. It sounds as if the other party has already contacted your mother's insurance company and been told that they won't pay. I'd definitely confirm that's truly the case. Since it was your mother's car which caused the damage, her liability insurance would be the coverage to pay the claim (unless, of course, your driving it without her permission prevents that from being required).

Leaving the scene of an accident, driving without a license, and driving without insurance are all crimes in every state that I know of but that's a separate matter from paying for the property damage. In all likelihood, you can arrange through the small claims court to make payments to the other party until you pay off the damages awarded.
