I was in a no fault accident 1/15/09 basically we are at the "settlement negotiations" portion. I am talking with the other party's insurance claims adjuster on my own without an attorney.
The adjuster sent me an e mail asking for any other medical bills & told me if there were no others that we can begin "negotiating the settlement" I have no idea how to go about this.
The accident has caused my life a major inconvinience.. my car was totaled in the accident, my daughter was in the car so we needed to buy a new car seat, Can I get reembursed for the car seat?
Also I need to pay a friend to take me 46 miles in total per day to work because of my age the insurance company/car rental places would not allow me to have a rental nor would they allow a member of my household to get the rental car for me to use... so needless to say this has caused my life a major inconvinience... I did see a doctor shortly after the accident for severe back pain, the medical bill came to 890.00 my back ended up being sprained but I am still suffering from pain every now & again as a result from this accident.
How would I go about asking for compensation for something like this? i know people look at accidents like they hit the jackpot, thats not what I'm trying to do I just feel like I deserve a little more than a wrecked car, back pain & a daily bill for a 46 mile car ride to earn a living...

You start by simply asking -- the car seat is a no-brainer. Medical bills, if legitimate, should be no problem. Transportation costs? Who knows -- just ask but please be rational and keep an open mind. There are some real dopes handling insurance claims out there but there are also many, many excellent, well trained adjusters that have no interest in being stubborn or unfair. Not paying a fair settlement does not help an insurer in any way at all though there are some out there that have questionable claims practices. Usually the big companies like State Farm, Nationwide, USAA, etc. don't have time to wheel and deal trying to find ways NOT to pay someone -- it just isn't good business. Just approach this with an open mind and above all, don't get into a confrontation with the adjuster. If you absolutely cannot get anywhere with him/her then request his/her manager. Ask lots of questions if you don't agree with the numbers -- they'll tell you how they arrived at them and could be flexible. Last -- don't get a lawyer or threaten to unless you have simply exhausted all other means of settlement. Once it goes down that road you can be certain you lose 1/3 of your money. Period. trust me, a lawyer cares less about you that the adjuster does. (ugh). |
