Auto accident didn't get a ticket?

I had an auto accident passing through a stop sign some one hit me on my driver's side of tthe car, so who is at fault here, even if I did pass through the stop sign or only checked quickly..some reason cops never took my statement or asked me what was wrong, just took my details and gave back my papers, I had to call the police station to find out that I can pick up the report. so if I did'nt get ticket that is bad or good, so far it does'nt look good some witness claim I came past the stop sign don't know if the other side had stop sign but their bumper hit my car and if I had been speeding that I would have saved myself so I was'nt I was following the rule 25miles in residential area i NJ pls help anyone.
I said I did check before driving when I saw the cop was not interested in asking me what happened so I said I got hit on the driver's side for which the officer said it does'nt matter and left and he said I can drive away

"Fault" is a civil issue. The only people who really are concerned with fault are the insurance companies.

A police officer is concerned about violations of state and local law, that may or may not also help to determine fault. The officer has discretion as to issue a ticket of not. He may issue a ticket simply because he can prove a violation, or to help indicate who he thinks is at fault, or may choose to not add insult to injury by giving someone clearly at fault, a break.

The last appears to be the case here.
The stop sign means stop, not slow down. Once stopped you can not proceed until safe to do so, clearly it was not.

The only scenario that this would not be your fault is if it were a 4-way stop, you had stopped, then entered the intersection and the other car hit your drivers side.

If this is an intersection with a through street, you are at fault.

A 4-way has a couple things that could happen:
You both ran the sign: both equally at fault (You don't get right-of-way by not stopping)
You did not stop, he did then entered the intersection where you appeared in front of him. Your fault
Both stopped then went, his fault, you were on the right.

The police usually won't issue a ticket if they didn't witness the event. The insurance companies assign fault not the police. Statements of the drivers and passengers mean virtually nothing because people lie. Unless you have an independent witness who can testify that the other driver did something wrong if you had a stop sign you will probably be found at fault.

Whether or not you received a citation has nothing to do with liability. The fact is, you failed to stop and caused an accident. Call your insurance and let them pick up the rest. You will more than likely be found 100% at fault.

If you didn't come to a full stop at the stop sign and check for oncoming traffic before proceeding, you are at fault. Even if the other driver ran the stop sign too, each driver has a responsibility to do everything possible to avoid a collision.
