Backed into a neighbors car, is this my fault?

Where I live, there are parking spaces in front of my apartment building. There are visitor parking spaces on the opposite side of those. Today I am pulling my car out of my spot to move into another spot closer to my apartment. As i am backing out of the spot,*snow has covered my back window but i looked before i got in and no one was coming, its a very un busy parking lot* someone from the apartment building a few hundred feet away comes over and pulls right behind me to "pick someone up" in our complex. So, what happens? i slam right into the side of their car. Is this my fault? how the hell can it be? Where she parked is not a parking space. She said there were no other spaces open when in all reality there was. There were several visitor spots open and then there was the one i was moving to.
why is she driving her car from her building to ours to pick someone up and parking behind people?

Your fault, totally. They this new invention, called a snow brush (sarcasm - ark, ark!). You should check it out, it will take snow off the window likkety-split. It is illegal to drive without clearing your back window.
You backed up when you were not able to see in the rear view window. No excuse, sorry, your fault.
WHAT IF IT HAD BEEN A CHILD WALKING THROUGH THE LOT? iF YOU COULDN'T SEE SOMETHING AS BIG AS A CAR, YOU WOULD HAVE KILLED A CHILD IF THERE WAS ONE!

Unfotunately, from a legal standpoint it is your fault, you should have cleaned off your rear window before attempting to back out. I know a lot of people don't do this but legally you're at fault, sorry |

Unfortunately you should be found primarily at fault. She may carry a small percentage yet you have the responsibility to make sure your exit is clear until it's completed. Just the fact that you stated your back window was covered with snow is a tell tale sign, so it really doesn't matter if she was parked or moving you wouldn't have seen her.

If this is a private space, nobody is at fault because traffic law does not apply to private spaces. You need no insurance, no registration, no nothing.
Don't let anyone convince you of anything.
There are NO rules in private spaces.
If they hassle you, get a lawyer and sue them for harassment. |

Yes, this is your fault. You backed into another car.
You should have cleared your back window, so you could see out of it.
It doens't matter WHY she parked illegally, or that she was illegally parked, or stalled, or even sitting in her running car. All that matters, is that you backed into her. Sorry. |
