My boyfriend went outside a few weeks ago & noticed that someone had hit his car taking off a significant portion of his rear quarter panel. As he was taking pictures of it, a girl who lives in our apartment complex came outside & admitted she had done it. They exchanged information, my boyfriend reported it to his insurance company, & got estimates for the damage. Now the girl is ignoring him. Every time he knocks on her door she won't answer, & every time he calls her she doesn't pick up (he has left numerous voicemails). He has tried knocking & calling at many different times of day with no luck. Is there anything he can do here?

Here are three things you can do!
The first thing you can do since you have her address is send her a certified letter stating that she has 10-days to contact you with a solution or you will be turning her name over to the police for hit and run. That should definitely get her attention.
If for some crazy reason she ignores your certified letter, you can make good on your promise to report her to your local police department. What she did was "hit and run" since she left the scene of the accident without reporting the damage. I'm sure that she will pay attention when the cops are the ones leaving voice mail or knocking on her front door. As drastic as that may seem, at least you gave her fair warning. If she continues to ignore you, she deserves what she gets!
The final solution if you don't want to call the cops is to have your insurance company pay for the damage as a claim against your policy. Your insurance company will then subrogate against her and/or her insurance company. The downfall with this plan is that you will have an claim against your policy and you might have to pay a deductible until your insurance company is able to collect from the girl or her insurance company.
The good news is that it won't delay the repair of your car and the insurance company will reverse the claim against your policy when they collect. This plan takes the pressure off your boyfriend to collect and puts it in the more powerful hands of his insurance company.

Boyfriend needs to let his insurance company handle this under his collision. The other party is far more likely to respond to the insurance company when they come-a-calling for reinbursment. |

If he has reported it to his insurance company, they should be handling it, not him. Call them and ask them to do what is needed to get the vehicle fixed. They will contact her insurance company on his behalf. |

Don't go near her or try to contact her. You will only aggravate the situation. You should be contacting your insurance company tosee when the reapirs will be made. And if there was no police report filed do it NOW! |

The thing to do would have been to call the police and have them come to the scene while the two parties involved were still at the scene.
If she hadn't admitted the the incident the thing to do would have been to report a hit and run.
See if you can find paint chips from the point of impact to determine the color of the car that struck your boyfriend's vehicle.
Observe this woman and see if she has a vehicle. See if there is any damage to her vehicle or if it has been recently repaired.
After you have some imformation you can take that to the police and tell them your story and report the hit and run.
If she wasn't just messing with you and actually did hit the car and was honest enough to admit to it; then if you can get the police to question her I imagine she won't change her story. |

Did this girl have insurance, and if so, why is the bf calling her, he should deal with her insurance company. Did she put it in writing that she did this, if not, it will be considered hearsay, and the bf will need to claim the repairs on his insurance. |

Your boyfriend reported it to his company, she probably reported it to hers. Her company most likely told her NOT to speak to him. Now, this is up to the insurance companies to handle. His insurance should pay for his damages, less his deductible and then will go after her insurance company to get back their money and his deductible by what is called subrogation. If she doesn't have insurance, his company will go after her for the money. If she can't pay in one lump sum, they will probably put her on a payment plan. Either way, he should stop trying to contact her. If she reported it to her company, it is out of her hands and if he keeps it up, she may report him to the police for harassment. I'm sure your boyfriend doesn't want that to happen. Good luck with the claim! |
