In September I wrecked a hertz rental car that I had while my car was in the shop due to another accident. I had full coverage on my own car, and when the accident happened my insurance paid for the rental to be fixed with me paying the $500 dollar deductible to hertz. Yesterday I got a letter from Hertz giving me 20 days to respond to a lawsuit they are filing seeking compensation for the "downtime" of the rental car. My insurance company is giving me the run around. One person is saying they will pay it, while another says it is my problem. Any advice??

you should talk to a lawyer about it, if you have a copy of an agreement you signed it could say somewhere on there about you'd might have to pay for "down time" if the car is wrecked, if it doesn't talk to a lawyer, even let the lawyer look at any paper work |

Tell Hertz to go f**k themselves. They are just trying to strong-arm you. If they are stupid enough to actually take you to court then your insurer will defend you. |

You need to send a copy of the letter to your insurance carrier via certified mail, return receipt requested. They should be protecting you from this type of lawsuit.
Did the letter come from Hertz or an attorney? Did they send a copy of the lawsuit? How can you possibly respond to something that they haven't presented you with. They are using a strong arm tactic to get you to motivate your insurance company to pay. If your insurance company refuses to pay, you'll have to get an attorney to defend you and also to sue your insurance company. You have to read both the rental contract and your insurance policy to see what's covered.
