Can I sue a drunk driver for hitting my parked car? Last night a guy hit my parked car and flipped his own. The cops came and hand cuffed him. It looked to be a DUI. The car isn't his, it's his girlfriends. Anyways my car may be totaled. Can I sue her for inconvenience and monetary losses. Since I now have to purchase a brand new car and open a new 5 loan. My car is worth 16000 on Kelley Blue Book and I still owe 7000 on my totaled car. What are my options. Please help!

If you have insurance on your car take the claim to your insurance company to handle. You know who is to blame and trying to get money out of them will be hard because of the DUI their insurance company can decline to pay out. If you let your insurance company look after it they should help you out and then they will chase the other party down for the cost of repairs

Since you still owe on it, you do have full coverage, right? In case they are not insured, that's where you might end up getting out of the deal.
Yes, you can sue anyone for anything. In this case, it would be a civil suit. While you could obtain a judgement, regardless of what the amount is, you'd still need to collect. If this guy doesn't have money or property, you won't get anything. If you do sue and get a judgement, you're going to want to find out what property he owns and put a lien on it. |

Your insurance company is going to sue for you, and you can also sue for other reasons. However in NY, the drunk driver can sue you just because your car was there in the first place, and in NY your insurance will go up too simply because you were "involved" with this accident. I really hate NY! |

See if insurance will cover it. Because HE backed into YOU, and you weren't moving, it shouldn't be your fault, and him and his/his girlfriends insurance company should have to pay for it. You should be able to get the damages covered, or they might even replace your car altogether. |

You can file a claim against the insurance company that insures the car he was driving.
Or
You can file against your collision coverage and your insurance company will pursue the at fault carrier for re-payment. |
